TERMS OF SALE

The sale of the products contained in this price list takes place in accordance with conditions which are considered in force from the date of order confirmation.

Product codes are subject to change without notice.

orders

MiDo S.r.l. only accepts written orders that contain a description of the product and quantity. The order is considered accepted when MiDo S.r.l. sends the order confirmation to the Customer.
For amounts less than €500.00, €30.00 will be charged for administrative costs.

prices

The prices on sale are expressed in euros and are exclusive of VAT. The sales prices are indicative and MiDo S.r.l. reserves the right to update them without notice

payments

In case of failure to comply with the payment conditions, MiDo S.r.l. reserves the right to cancel the entire order or the part not yet processed and to demand immediate payment for the products already supplied.
In case of non-payment, MiDo S.r.l. will apply late payment interest increased by 10% on the discount rate. Late payment interest is automatically due from the invoice due date. The Customer cannot decide to exercise the right to defer payment.

delivery

The delivery term starts from the date indicated in the order confirmation and is not to be considered binding.
Delivery: ex customer warehouse only for invoice amounts exceeding €1,000.00.
MiDoMet S.r.l. you free yourself from the obligations related to delivery by returning the goods to the carrier and/or forwarder (art. 1510 of the Civil Code).
From this moment on, the Customer assumes the risk of theft, loss and/or damage to the goods even when transport is carried out by MiDo s.r.l. the risk is governed by the current version of the Incoterms table.
If the customer does not collect the goods within the established time and place, he must still make the payments established by the contract, as if the goods had been delivered.
The packaging used is that necessary for normal transport conditions. Additional packaging will be paid by the Customer.

warranty

Products supplied within the European Union are covered by a 24-month warranty for defects in conformity starting from delivery (Legislative Decree 24/2002, Directive 1999/44/EC); the provisions of the individual states apply to products supplied outside the European Union.
The guarantee covers defects in design, workmanship or material; does not cover defects resulting from faulty installation, maintenance, or deterioration repairs; does not cover defects caused by failure to comply with the regulations or laws in force.
The warranty becomes void in the event of failure to comply with the instructions or warnings.
The defect must be communicated within 2 months from the moment of discovery, under penalty of forfeiture of the warranty .
Preventive replacements not agreed upon with the Company are excluded from the warranty.
Products that have been tampered with or present damage or faults caused by extraneous factors or force majeure (for example: conditions of use) are not covered by the warranty. unsuitable, frost, water, corrosive, fire, excessive stress, intentional damage). Goods returned due to incorrect purchase or returned with packaging damaged beyond repair are not covered by the guarantee.
MiDo S.r.l. does not replace under warranty products with defects of conformity of which the Customer was aware at the time of the order.
The Customer will not be able to make any claims for injuries to persons or damage to property other than those which are the subject of the contract, or for lost profits.

returns and repairs

To return the goods it is necessary to request authorization from MiDo S.r.l.
To make a return it is necessary to complete and send it to MiDo S.r.l. the "Customer Returns Communication" form which can be requested from the sales staff.
The transport costs for returning the goods are always borne by the Customer; freight collect shipments will be rejected.
The returned goods will be analyzed to verify the existence of the problem by the Customer; if it is defective, MiDo S.r.l. will decide whether to repair or replace it; if no problems are found, the goods will not be replaced and MiDo S.r.l. you may decide to charge the costs of the analysis. The minimum billable for repairs not under warranty is €50.00.
